Terms of Service
Acceptance of These Terms
By accessing or using the QuizMyBrainz Portal at quizmybrainz.com/qmbportal/quizzes/ (the "Portal"), you agree to these Terms of Service ("Terms"). If you are a parent, guardian, or teacher allowing a child to use the Portal, you accept these Terms on the child's behalf and are responsible for the child's use. If you do not agree, do not use the Portal.
Who Operates the Portal
The Portal is operated by mar&mar ideas products & more, LLC ("we," "us," "our"), a Texas limited liability company. Contact: privacy@quizmybrainz.com.
Who May Use the Portal
The Portal offers educational activities for children in PreK through 6th grade. Because it is directed to young children:
- A parent, guardian, or teacher should supervise a child's use.
- There are no user accounts and no login. A child does not need to register.
- You agree not to use the Portal for any purpose that is unlawful or prohibited by these Terms.
No Accounts; Information You Provide
The Portal does not require registration. A child may optionally enter a first name or nickname and select a grade and language so the activity displays correctly. How we treat that information is governed entirely by our Privacy Policy. Privacy Policy.
Please do not enter a child's full name, contact details, or any sensitive information into the Portal — it is neither needed nor requested.
Acceptable Use
When using the Portal, you agree not to:
- Attempt to gain unauthorized access to the Portal, its servers, or any related systems;
- Probe, scan, or test the vulnerability of the Portal except through the confidential reporting channel in Section 11;
- Interfere with or disrupt the Portal (for example, through automated scraping, denial-of-service activity, or injecting malicious code);
- Circumvent any security or access controls;
- Use the Portal to violate any law or the rights of others; or
- Misrepresent your identity or your authority to act for a child.
Educational Purpose; No Guarantee of Results
The Portal provides educational activities for general enrichment. It is a learning aid — not a substitute for a curriculum, professional instruction, assessment, or professional educational advice. We do not guarantee any particular learning outcome, score, or academic result.
QuizMyBrainz activities are designed to complement classroom instruction and home learning. They are not diagnostic tools and do not produce school-reportable assessments.
Intellectual Property
The Portal — including its activities, text, graphics, layout, code, and the QuizMyBrainz name and branding — is owned by or licensed to mar&mar ideas products & more, LLC and is protected by intellectual-property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Portal for its intended, non-commercial educational purpose. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Portal or its content without our written permission, except as permitted by law.
Teachers may use the Portal with their classes for non-commercial classroom instruction without separate written permission.
Third-Party Links
The Portal may link to third-party sites we do not control. We are not responsible for their content, practices, or policies. Following such links is at your own risk.
Changes to the Portal and to These Terms
We may modify, suspend, or discontinue any part of the Portal at any time. We may also update these Terms; when we do, we will revise the "Last Updated" date and post the new version at this URL. Continued use after changes are posted means you accept the updated Terms.
For any material change affecting children's information or significantly affecting your rights, we will provide at least 30 days' advance notice by posting a prominent notice on the Portal before the change takes effect.
Disclaimers
THE PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Portal will be uninterrupted, error-free, or secure. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
Security Reporting
If you believe you have found a security vulnerability in the Portal, please report it confidentially to oscarpureco@quizmybrainz.com rather than disclosing it publicly. We appreciate responsible disclosure.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, mar&mar ideas products & more, LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Portal.
Indemnification
You agree to indemnify and hold harmless mar&mar ideas products & more, LLC from claims arising out of your misuse of the Portal or your violation of these Terms or applicable law.
Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules.
Any dispute arising from these Terms or your use of the Portal will be resolved in the courts of Tarrant County, Texas, and you consent to personal jurisdiction there. Nothing in these Terms limits any rights you may have under the mandatory consumer-protection laws of your country of residence.
Severability; Entire Agreement
If any provision of these Terms is held unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Portal. Privacy Policy.
